What Makes a Flange
U.S. Compliant?

Flanges, fittings, and piping system components must meet certain requirements for use, such as ASME/ANSI standards or AWWA specifications. These designations cover safety and application conditions, but other specifications, such as BABA, Buy America, Buy American, and American Iron and Steel (AIS), establish requirements for where components may be sourced from, and where manufacturing and finishing must occur. These specifications may be designated by funding source, project type, or regional or federal requirements.

BABA (Build America, Buy America)

AIS (the American Iron and Steel)

Domestic Sourcing Requirements

Build America, Buy America (BABA)

Effective May 14, 2022, the Build America, Buy America Act introduced expanded domestic sourcing rules for all federally funded infrastructure projects.

  • BABA requires that iron and steel items be entirely produced in the United States, that manufactured products include more than 55% domestic component cost, and that construction materials undergo 100% of their manufacturing processes domestically.
  • These rules apply to all federal financial assistance programs — including SRF, WIFIA, WIIN grants, and other EPA-administered infrastructure funding.
  • BABA is Public Law 117-58 included in the Infrastructure Investment and Jobs Act (IIJA), also known as the Bipartisan Infrastructure Law (BIL)– under Title IX, Subtitle A, Part I – Buy America Sourcing Requirements.

AIS & Buy America Requirements

AIS applies to water and wastewater infrastructure projects, while Buy America applies to federally funded transit and public infrastructure programs. Both standards require domestic production, but differ in thresholds and covered materials. Under these rules, a project cannot use federal funds unless qualifying iron, steel, manufactured products, and construction materials are produced in the United States. The EPA continues to gather industry feedback through listening sessions to refine how these categories are defined and applied across different project types.

Iron & Steel Requirements

Iron and steel items must have all manufacturing processes completed within the United States. It includes melting, refining, forming, machining, and coating. Under BABA, the definition applies to any item predominantly made of iron or steel. A commonly used guideline is whether the furnace used to melt the material is located in the U.S.; if it is, the item generally qualifies under federal domestic sourcing rules.

Manufactured Products

Manufactured products must meet two core requirements: the final product must be manufactured in the United States, and the cost of U.S.-origin components must exceed 55% of total component cost. This category includes multi-component items such as pumps, motors, blowers, actuators, valves, and similar assemblies. The EPA is continuing to refine how complex items are classified as manufactured products or construction materials, but most assembled components will fall under this category.

Construction Materials

Construction materials qualify when all manufacturing processes occur within the United States. This includes non-ferrous metals, plastics and polymer-based products such as PVC, HDPE, and composites, as well as glass, optic glass, lumber, and drywall. Materials excluded from this category include iron and steel products, cement and cementitious materials, aggregates such as sand or gravel, and aggregate binding agents or admixtures.

What Waivers are There for BABA?

The U.S. EPA has the authority to waive BABA based on three waivers: a public interest waiver, a non-availability waiver, and an unreasonable cost waiver.

The Public Interest Waiver is used when “applying the domestic content procurement preference would be inconsistent with the public interest.”

The Non-availability Waiver is used when the “types of iron, steel, manufactured products or construction materials are not produced in the United States in sufficient and reasonably available quantities or of satisfactory quality.”

The Unreasonable Cost Waiver is used when the “inclusion of iron, steel, manufactured products, or construction materials produced in the United States will increase the cost of the overall project by more than 25%.

Questions

Buy America

The Buy America Act is a requirement applied to infrastructure projects that use federal funding to ensure taxpayer-funded grants are used to purchase American-made components rather than non-domestic parts. Buy America, which applies to state and local government level projects funded by the Federal Transit Authority (FTA), requires the construction materials are 100% domestic.

Buy American

It covers a wider variety of projects and is more likely the specification followed for the purchases of flanges and piping system components. The Buy American Act was signed in 1933 to require that materials purchased for government-related projects are forged and machined by American manufacturers. The law applies to the purchase of end products intended for use within the USA, with a requirement that the items are manufactured with at least 50% domestic materials.

Made in the USA

A “Made in the USA” designation does not guarantee that the finished product complies with all AIS, Buy America, or Buy American requirements. Further documentation is required to ensure the raw materials and manufacturing methods meet required conditions—typically a Mill Cert or MTR is used to confirm compliance with AIS or Buy American requirements.

Made in America/Made in USA

“Made in America/Made in USA” designations only ensure a U.S.-based production location—but this does not guarantee that the manufacturer used domestic materials. Because Made in USA products may not be manufactured using domestic materials, this label alone does not ensure compliance with AIS, Buy American, or Buy America, all of which require that materials, processing, and production occur within the United States.

Absolutely. Domestic-compliant flanges still meet the same ASME or AWWA dimensional standards and can be used in the same piping systems. The difference is that their material origin and manufacturing processes satisfy AIS, Buy America, or BABA requirements.
